1. Acceptance of terms
By creating an account or using Swiftlee, you agree to these Terms of Service and our Privacy Policy. If you are entering into these terms on behalf of a company, you represent that you have authority to bind that company.
2. The service
Swiftlee provides bilingual phone answering services on a subscription basis. The specific features available to your account depend on the plan you select. We may change pricing and features with reasonable notice.
3. Your account
- You must provide accurate registration information
- You are responsible for maintaining the security of your account credentials
- You must be at least 18 years old to create an account
- You are responsible for all activity that occurs under your account
4. Acceptable use
You will not use Swiftlee to:
- Violate any applicable law or regulation
- Impersonate any person or entity, or misrepresent your affiliation
- Send unsolicited commercial messages or robocalls
- Interfere with or disrupt the service
- Reverse-engineer or attempt to extract source code from the service
5. Billing
- Subscriptions are billed monthly in advance
- Overage charges are billed at the end of each billing period
- You may cancel at any time from your portal
- Refunds are at our discretion — see the cancellation flow for details
6. Content ownership
You retain ownership of your business content (scripts, FAQs, escalation contacts) and your call data (recordings, transcripts, messages). We retain ownership of the Swiftlee platform.
7. Service availability
We target 99.9% uptime. Scheduled maintenance will be announced in advance. We are not liable for downtime caused by third-party telephony providers, internet outages, or force majeure events.
8. Termination
Either party may terminate this agreement at any time. Upon termination, your access to the service will end at the end of your current billing period. We may suspend or terminate your account immediately if you violate these terms.
9. Disclaimer of warranties
The service is provided “as is” without warranties of any kind. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of liability
To the maximum extent permitted by law, our liability for any claim arising out of or relating to these terms is limited to the amount you paid us in the 12 months preceding the claim.
11. Governing law
These terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in San Diego County, California.
12. Changes to these terms
We may update these terms from time to time. Material changes will be announced via email or in-portal notice at least 30 days before they take effect.
